Doctor perscribed antibiotics he feels are not necessary before seeing patient. Is this medical malpractice? - well wishes for a stroke patient

My father is in rehab after his stroke. He had made a tracheotomy, and, recently, we (the family) began a foul odor found when you cough up blood in the sputum. After noting that the nurse, a test of his sputum, and two bacteria have been found. My father was put on antibiotics.

Two days later, (his doctor who has seen everything twice in the last three months) said just that perscribed in his professional opinion, the father was not an infection, and no reason for him on the SE antibiotics. I have also noticed that this is really dangerous for the father as a treatment with antibiotics, but there were mainly that it was the wish of the family. Was not that - just wanted to know whether an infection.

Today we learned that they were raised more than $ 1,500 for drugs that have asked (never). Insurance does not cover. Is this legal? What can we do? We can not be sure.
